Agreement to Terms
These Terms of Service ("Terms") constitute a legal agreement between you and Austin Moving Services ("Company," "we," "our," or "us") regarding your use of our moving services and website. By booking our services or using our website, you agree to be bound by these Terms.
Services Provided
Austin Moving Services provides professional moving services including but not limited to:
- Local residential and commercial moving
- Long-distance and interstate moving
- Packing and unpacking services
- Furniture moving and assembly
- Storage solutions
- Specialty item moving (pianos, safes, etc.)
All services are subject to availability and are provided in accordance with these Terms and applicable federal and state regulations.
Estimates and Pricing
Estimates
Estimates provided are approximate and based on the information you provide. Final charges may differ based on actual services rendered, items moved, time required, and unforeseen circumstances. We provide free estimates but reserve the right to adjust pricing based on actual conditions.
Local Move Pricing
Local moves are charged on an hourly basis with minimums as stated in your estimate. Time begins when our crew leaves our facility and ends when they return. Additional charges may apply for stairs, long carries (over 75 feet), shuttle services, or special equipment.
Long-Distance Pricing
Long-distance moves are priced based on weight and distance. Final cost is determined after weighing your shipment. Binding estimates are available upon request and guarantee the price will not exceed the quoted amount.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, credit cards, debit cards, checks, Venmo, and Zelle. A deposit may be required for long-distance moves or during peak season. Returned checks will incur a $35 fee.
Booking and Cancellation
Reservations
Moving dates are reserved on a first-come, first-served basis. We recommend booking at least 2-4 weeks in advance, especially during peak season (May-September). All bookings must be confirmed in writing.
Cancellation Policy
- Cancellations made 48+ hours before scheduled move: Full refund of any deposit
- Cancellations made 24-48 hours before scheduled move: 50% deposit retention
- Cancellations made less than 24 hours before scheduled move: Full deposit retention
- No-shows or same-day cancellations: Full deposit forfeiture plus potential additional charges
Rescheduling
We understand that plans change. You may reschedule your move up to 48 hours in advance without penalty, subject to availability. Rescheduling requests within 48 hours of your move date are subject to the cancellation policy.
Customer Responsibilities
Preparation
You are responsible for:
- Providing accurate information about items to be moved and access conditions
- Disconnecting and preparing appliances for moving
- Securing parking permits and elevator reservations if required
- Removing personal items from drawers in desks and fragile items from furniture
- Having utilities connected at destination for appliance installation
- Securing pets and small children on moving day
Access
You must provide clear access to both pickup and delivery locations. If our crew encounters locked gates, unavailable parking, or other access issues not disclosed during booking, you may be charged for additional time and expenses.
Prohibited Items
We cannot transport:
- Hazardous materials (gasoline, propane, paint, chemicals, explosives)
- Perishable food (for long-distance moves)
- Plants (for interstate moves due to agricultural regulations)
- Pets
- Cash, jewelry, important documents, or irreplaceable items
- Loaded firearms
- Illegal substances or contraband
Insurance and Liability
Basic Liability
All moves include basic liability coverage at no charge, providing $0.60 per pound per item. This is the minimum coverage required by federal regulations. For example, a 50-pound item would be covered up to $30.
Full Value Protection
Full value protection insurance is available for purchase and covers items at their full replacement or repair value. We strongly recommend this coverage for moves containing high-value items, antiques, or artwork.
Claims Process
All damage or loss claims must be reported within 9 months of your move date. Claims should be submitted in writing with supporting documentation including photos, original receipts, and detailed descriptions. We will investigate all claims and respond within 30 days.
Limitations of Liability
We are not liable for:
- Damage to items improperly packed by the customer
- Pre-existing damage to items or property
- Loss or damage to prohibited items
- Damage resulting from acts of God, natural disasters, or events beyond our control
- Mechanical failure of appliances after disconnection and reconnection
- Delays caused by weather, traffic, or circumstances beyond our control
Delays and Force Majeure
While we make every effort to complete moves as scheduled, we are not liable for delays caused by circumstances beyond our reasonable control, including weather, traffic, mechanical breakdowns, or other force majeure events. We will make reasonable efforts to notify you of significant delays and reschedule if necessary.
Storage Terms
If using our storage services:
- Storage fees are charged monthly in advance
- You must provide 30 days notice before removing items from storage
- Storage units are climate-controlled but we recommend insurance for high-value items
- Unpaid storage fees over 60 days may result in lien placement and sale of goods
- You are responsible for insuring stored items through your own insurance or our optional coverage
Dispute Resolution
Any disputes arising from these Terms or our services will be resolved through binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits against the Company.
Governing Law
These Terms are governed by the laws of the State of Texas and applicable federal regulations including the Federal Motor Carrier Safety Administration (FMCSA) regulations for interstate moves. Venue for any legal proceedings is exclusively in Travis County, Texas.
Limitation of Liability
Our total liability for any claim arising from our services shall not exceed the actual charges paid for the services in question, or the amount of insurance coverage selected, whichever is greater. We are not liable for consequential, incidental, or punitive damages.
Indemnification
You agree to indemnify and hold harmless Austin Moving Services, its employees, and agents from any claims, damages, or expenses arising from your breach of these Terms, your negligence, or your violation of any law or regulation.
Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with your estimate/invoice and our Privacy Policy, constitute the entire agreement between you and Austin Moving Services regarding our services and supersede all prior agreements and understandings.
